Salty Sydney Harbour Pty Ltd advises you to review the following basic rules that govern the use of our Site (the “Agreement”). Please note that your use of our Site constitutes your agreement to follow and be bound by this Agreement.
GENERAL INFORMATION
Attire. Comfortable clothing and dressing in layers, a warmer fleece style jacket, a snug fitting cap, sunglasses with safety strap, sunblock and towel is recommended. Guests are to wear soft soled, non- marking shoes. Guests are recommended to bring a rain jacket or poncho if the weather forecast shows rain or windy conditions. Guests are to ensure their items are secured in a suitable bag and stored below deck.
Briefing. The Captain will provide a thorough safety and operations briefing.
Catering. Guests are welcome to bring a reasonable amount food and drinks. Small to medium sized platters or boxed catering is best, large platters difficult to store aboard. Plates, bowls, wine glasses, rubbish bags are aboard for Guest use free of charge. Note: The Captain is not responsible to serve food or drinks. A Hostess is available at $60 per hour if required.
Cooking Aboard. A gas yacht stove and or two burner cook top is available for simple heating of food. Please call for details to ensure our stove can heat your food efficiently.
Damage / Marine Toilet / Cleaning. Any loss or damage to the yachts or equipment will be charged. A charge of $250 will be charged if the toilet is blocked by Client’s Guests.
Duration. The Operator is not responsible for any delays caused by the late arrival of passengers or delays at the wharf caused by crowds. The Operator reserves the right to pull into the point of disembarkation 10 minutes prior to the scheduled time for disembarkation. The time for disembarking passengers is 15 minutes maximum.
Health. Any Guest displaying flu like symptoms, including a fever, cough or runny nose, may be refused entry (in its discretion).
Lifejacket policy. All children under 12 years of age must wear a buoyancy vest. Single person hirers must wear a buoyancy vest.
Refrigeration. Our yachts have ice box and eskies or electric or eutectic refrigeration systems that can store a reasonable amount of food and drinks. Access into the fridges is limited and do not suit large platters, please call for details. Ice is extra cost if required, please bring your own or order 72 hours in advance at $10 per 5kg bag.
Yacht. The Operator reserves the right to change a Client’s booked Yacht to another Yacht of similar size and/or style as possible or cancel or postpone any booking.
Swimming. Guests are advised to take precautions when swimming or when using the Aqua Lily. The Skipper is not a Lifeguard and not responsible for the health and safety of the Guests when they are off the yacht. Guests swimming need to bring their own towel.
POSTPONEMENTS AND CANCELLATIONS
Cancellation by Client. All moneys already paid by the Client to the Operator by that day of cancellation shall be forfeited.
Postponements. Bookings can be postponed with 6 weeks written notice minimum. Rescheduled dates are to be inside of 12 months from the original booked date and time. The Rescheduled date needs to be booked with The Operator by the Client but is subject to availability. Postponements are subject to an additional Postponement Administration Fee of 10% of the total Charter Fee paid by the Client. Any irreversible expenses incurred by the Operator such as wharf fees, special Costs requiring more than 6 weeks’ notice period or any associated fees will be to the expense of the Client.
Refunds. The Operator does not refund any fees paid to the Operator by the Client under any circumstances.
SPECIAL NEW YEARS EVE POLICY
Deposit. Payable upon booking. Full payment is required or 50% if agreed by The Operator.
Final Payment. Is due at the latest 1st October.
Refunds and Cancellations. Are not available for New Years Eve for any Clients.
OTHER CONDITIONS
Strong Wind Cancellations of Yacht Charters . All our boats have sun and rain protection. If it is rainy, we still expect you to go. If the winds are dangerous (over 25 knots over a continuous period of 3 hours) our hire bookings may be cancelled by the Operator.
Any irreversible expenses incurred by the charter vessel operator for this particular charter, such as skipper / captain and crew costs, wharf fees, catering already prepared, or any associated fees may be to the expense of the Charterer.
Note: New Years Eve Charters shall go ahead regardless of the weather.
Force Majeure. The Operator will be free from liability for failing to perform hereunder due to industrial action, severe weather conditions*, technical problems or other events beyond The Operator’s reasonable control. The Client’s booking including all payments made by the Client will be held and the Charter rescheduled within a 12-month period.
Indemnity. The Client agrees to indemnify and hold harmless The Operator, its agents and employees, from and against any and all losses, claims, actions, costs, expenses, fees, damages, fines and liabilities (including reasonable legal fees) caused by any negligent act or omission by the Client or Client’s group.
SPECIAL GENERAL INFORMATION FOR HIRE AND DRIVE CUSTOMERS
Briefing. The Operator will provide a comprehensive safety and operations briefing prior to departure. The Hirer and or Skipper shall sign the Briefing Document to ensure compliance will be made to all safety and operating procedures during the Hire.
Catering. Hirers are welcome to bring food and drinks. No metal eskies are permitted.
Client Behaviour. Skippers who are deemed to have blood alcohol content of over 0.05% will be reported to Sydney Water Police. Passengers are requested to behave in a proper manner and not cause discomfort or be a nuisance to others on the waterway. Security Bonds will be held by The Operator if negligent or unsociable behaviour is exhibited by the Hirer or Passengers.
Damage to Hire Boat. The Hirer shall be held fully responsible for all loss of or damage to the Hire boat or equipment or motor or to others affected. If the Hirer has caused damage or loss; the Security Bond will be banked asap, and quotations sourced to rectify such damages and losses.
Rescue. Use of The Operators rescue vessel to find and assist The Hirer will be charged at $250 minimum.
Diver. Use of any underwater operations to assist in the safe return or proper repair of the boat will be at $300 per hour minimum charge.
Hire Navigation Limits: Northern Limit; line between Watsons Bay and Georges Head, Western Limit; Gladesville Bridge or Lane Cove River. No vessels can go to Manly, Out of Sydney Heads or to Middle Harbour.
Out of bounds areas: Vessels are NOT permitted into Circular Quay or alongside wharves or beached at an island or beach.
Insurance. Hirer and Passengers are insured with third party insurance unless Hirer operate the Hire boat outside of the Limits or do not abide by this Hire Agreement. Hirers in breach of these terms will be liable for all repairs, replacements or loss.
Security Bond Return. The Bond is not returned until the boat has been checked by the Operator and cleared of damage and no other third parties make claim on the Hirer’s behaviour during their Hire period. This can take 2-3 working days after the Hire.
SPECIAL CONDITIONS FOR HIRE AND DRIVE CUSTOMERS - PAYMENTS, POSTPONEMENTS AND CANCELLATIONS
Postponements and Refunds. Hirers can be refunded all monies paid (less $50 administration fee) if Client provide 72 hours notice in writing to salty@saltyboathire.com. If the Hirer wants to cancel a booking within 72 hours of the Hire; all moneys paid by the Hirer shall be forfeited.
Postponements by the Operator. Within 24 hours of a booked Hire, The Operator may cancel the Hire if the weather is deemed unsafe or boats are not available due to mechanical issues. Hirers will be provided with a full refund
Security Bond. Is payable on arrival cash or credit card. $1000
All products purchased from the website are transported and delivered to you by an independent carrier not affiliated with, or controlled by, Salty Sydney Harbour Pty Ltd. Title to the products purchased on the website, as well as the risk of loss for such products, passes to you when Salty Sydney Harbour Pty Ltd delivers these items to the carrier.

Failure of Saturdaysnyc.com to enforce any provision of this Agreement shall not constitute or be construed as a waiver of such provision or of the right to enforce such provision.
This Agreement shall be construed in accordance with the laws of the State of New South Wales, without regard to any conflict of law provisions. In any action arising under this Agreement, you consent to the jurisdiction and venue of the state and/or federal courts of the State of New South Wales, Country of Australia.
